Derath Penalty Indictment Returned in Murder/Robbery of Store Clerk

The Hamilton County Grand Jury has indicted Dale Phillips (M/B/23) for the November 17, 2007 murder and robbery of clerk, Christopher Spencer, at the RIL World Clothing Store on Galbraith Rd in North College Hill.

In addition to this incident, this Defendant was indicted for the Aggravated Robbery with a gun of the Ameristop Store on November 3, 2007. The Ameristop is adjacent to RIL World Clothing in North College Hill.

The Aggravated Murder charge with specifications carries the possibility of the death penalty.

The defendant was indicted for Weapons under Disability in both incidents as a result of an April 2003 conviction for Robbery with a gun specification. Phillips had recently been granted Judicial Release in February of 2007 after serving a little over 4 years on the previous Robbery conviction.

Prosecutor Joe Deters called the killing "one of the most cold blooded murders" he has seen in his years Hamilton County Prosecuting Attorney.
