Hamilton County Prosecutor announces a capital indictment for the murder of an 18-month-old boy

Hamilton County Prosecuting Attorney Joseph T. Deters announced today the capital indictment of Derris Smith for the murder of 18-month-old Malikai Glenn.

On June 27, 2007 at 12 p.m., Smith, 18, was at the home of his girlfriend, located on President Drive in Cincinnati, when he became frustrated with his girlfriend’s son over a toilet training incident. Smith violently slammed the young child’s head against the wall causing his death.

The defendant was 17 at the time of the offense. Under Ohio law, a juvenile cannot receive the death penalty. Smith now faces Life in prison without parole.
