Hamilton County Prosecutor Joseph T. Deters announces dismissal of Felonious Assault and Rape charges against Lenny Love

Today, Hamilton County Prosecutor Joseph T. Deters announced the dismissal of Felonious Assault and Rape charges against Silverton resident Lenny Love (DOB 1/24/82).

On July 1, 2011 Silverton Police charged Love with Felonious Assault and Rape after he told a relative and the police that he had raped a 6 month-old baby.  Love also said that he was HIV positive.

Following the accepted procedure in cases of this type, the baby was examined at Children’s Hospital for possible injuries consistent with Love’s statements.   The baby did not exhibit any injuries.  A physical examination of Love revealed that he is not HIV positive.  Given the serious nature of the case, the state also asked the court to order a mental evaluation of Love which the court granted.  Nothing in the court clinic evaluation supported Love’s claims that he had abused the baby and, in fact, raised concerns as to whether the incident had occurred.  

Given that no physical or circumstantial evidence supports the charges and, therefore, no basis to believe that the incident occurred, the Hamilton County Grand Jury today ignored the charges.

The Department of Jobs and Family Services and appropriate mental health authorities have been notified about Love’s statements and condition.

Prosecutor Deters commented, “I am relieved that the baby is fine and that this incident was the fabrication of a mentally unstable person.  We always take these allegations seriously and must be absolutely positive that the incident did not occur.”
