Hamilton County Prosecutor Joseph T. Deters announces no criminal charges will be filed in the crosstown shootout incident

Today, Hamilton County Prosecutor Joseph T. Deters announced that no criminal charges will be filed as a result of the physical altercations which occurred at the December 10, 2011 men’s basketball game between the University of Cincinnati and Xavier University. 

Mr. Deters and investigators reviewed films from the game and talked with University of Cincinnati Head Coach Mick Cronin and Xavier University Head Coach Chris Mack.  Further, investigators interviewed witnesses and players. 

Mr. Deters is also aware that Yancy Gates (University of Cincinnati #34) and Kenny Frease (Xavier University #32) reached out to each other privately and that Mr. Frease is satisfied with Mr. Gates’ apology.  

After this review, it was determined that criminal charges would not be filed.

Prosecutor Deters commented, “This was an unfortunate situation. However, after talking with both coaches, I truly believe that the teams will be able to deal with the situation more effectively than the criminal justice system.”
