Hamilton County Prosecutor announces death penalty indictment in murder of father-in-law

Today, Hamilton County Prosecutor Joseph T. Deters announced the indictment of David Franks (DOB 9-27-66) in the death of his father-in-law James Schobert.  Franks is charged with 2 counts of Aggravated Murder with a death penalty specification, 3 counts of Attempted Aggravated Murder (Special Felony) and 2 counts of Aggravated Burglary (Felony 1).  The Attempted Aggravated Murder charges are for firing upon the 3 responding police officers.  If convicted of all charges, he faces the possibility of the death penalty. 

On March 11, 2012 at approximately 3:30 a.m. the police were called to 4951 N. Arbor Woods Court in Green Township in response to numerous 911 calls for a “suspicious person” and later “man with a gun.”  When the police arrived, they saw a silhouetted individual (later identified as David Franks) enter the rear of the residence and heard gunshots.   Franks then exited the residence armed with a handgun.  The police ordered him to drop his weapon but he then began firing at the officers.  The officers returned fire and wounded Franks.  Franks was arrested at the scene.  No police officers were injured.

When the police entered the residence, they discovered that James Schobert had been shot.  He died as the result of gunshot wounds.

The police also found the defendant’s estranged wife, Sherry Franks and their 9 year-old daughter hiding in the home.  The victim’s wife, Marlene, who had been present in the home when her husband was shot, had been able to flee the home shortly before the police entered.

Franks was estranged from his wife, Sherry Franks.  He had previously been charged with Domestic Violence against her and a Temporary Protective Order had been granted.  Sherry and their 9 year-old daughter had recently been living with her parents.

Prosecutor Deters commented, “The cold-blooded murder of Mr. Schobert in front of his family is unthinkable.  David Franks should now face society’s ultimate penalty.”
