Hamilton County Prosecutor Joseph T. Deters announces indictment in aggravated vehicular homicide case

Today, Hamilton County Prosecutor Joseph T. Deters announced the indictment of Kyle Stein (DOB 5/5/95) in the September 13th Aggravated Vehicular Homicide of 16-year-old Rachel McGrath and 19-year-old Eric Moormann.  Stein is charged with 4 counts of Aggravated Vehicular Homicide (2 counts Felony 2 and 2 counts Felony 3).  If convicted of all charges, he faces the possibility of 16 years in prison and a life time driver’s license revocation.

On September 13th, Stein was driving a 2001 Audi on a curvy portion of Sheed Road in Colerain Township at approximately 7:30 p.m. in excess of the posted 35 miles per hour limit.  Stein was trying to catch up to a new model Audi R-8 to get a better look at this very expensive vehicle.   Stein tested positive for alcohol and marijuana with a Blood Alcohol Level of .113 which is in excess of the .02 limit for a driver under the age of 21.

McGrath, the front seat passenger, was pronounced dead at the scene.  Moorman, the back seat passenger, was dead on arrival at the hospital. 

Hamilton County Prosecutor Joseph T. Deters commented, “Two young lives were lost in a senseless tragedy.  Speed, alcohol, drugs and reckless driving are a fatal combination.”
