Our records indicate that this defendant is serving a sentence of 46 years to Life following convictions for Aggravated Murder, Attempted Aggravated Murder, Kidnapping, Felonious Assault and Aggravated Burglary.


As stated in our previous objections, Poindexter’s crimes call for nothing short of his life sentence. A jury saw fit to recommend the death sentence but this was later reduced to a life sentence by a federal court.



In 1985, Poindexter burst into the home of his ex-girlfriend, Tracy Abernathy, where she was sleeping with her one-year-old son and her boyfriend, Kevin Flanaghan. Poindexter shot Flanaghan in the chest, killing him. He struck Abernathy and ordered her to take her son downstairs.

When an unarmed security guard, John Hurt, responded to the apartment, he was confronted by Poindexter, who was forcing Abernathy and her son out the front door. Abernathy immediately told the guard that her boyfriend had been shot and Hurt followed her upstairs to investigate. But Poindexter followed and ordered Hurt to kneel on the floor and announced that he was going to kill both Hurt and Abernathy. He shot twice, execution-style, eighteen to twenty inches away from Hurt’s head and missed. His gun then misfired and he started to reload the revolver.

 Hurt radioed for assistance. Before police arrived, Poindexter pistol-whipped Abernathy twice and ordered Hurt and Abernathy outside. But police arrived, and Poindexter fled.

For murdering one person and attempting to execute two others, Poindexter should serve his entire life sentence in prison. There is nothing in the record to support anything less and this office will continue to object to any release of this prisoner prior to his natural death.
